MIOCC TERMS OF USE
Overview
These Terms of Use govern access to and use of the MioCC application. By installing, opening, activating or using MioCC, the user agrees to these Terms and any applicable license terms. The user also acknowledges that the MioCC Privacy Policy has been made available and describes relevant personal-data processing. MioCC is intended for adult users aged 18 or older.
Authoritative language
English is the authoritative language of these Terms. Translations may be provided for convenience. In the event of any inconsistency between versions, the English version will prevail to the extent permitted by applicable law.
1. Acceptance
The user must read and accept these Terms and any applicable license terms before using MioCC. The user must also read the MioCC Privacy Policy and acknowledge that the privacy information has been provided.
Acknowledgement of the Privacy Policy does not turn the Privacy Policy into a contract and does not constitute consent to every processing activity. Personal data is processed only on an applicable legal ground described in the Privacy Policy and required by applicable law.
If the user does not agree with these Terms, MioCC must not be used.
MioCC may request renewed acceptance when these Terms are materially updated. Changes will apply in accordance with applicable law, and mandatory rights that cannot legally be waived remain unaffected.
2. What MioCC is
MioCC is an offline-first privacy and content-protection application designed to encrypt and decrypt text and files provided or selected by the user.
Core encryption and decryption functions are performed locally on the user's device.
MioCC does not require original protected content, passwords, PINs or private cryptographic keys to be sent to the MioCC owner or developer merely in order to perform local encryption or decryption.
Certain functions that are separate from local content processing, including licensing, activation, updates, support or other supporting services, may require communication with external systems, as described in the Privacy Policy.
3. User-provided content and local processing
MioCC processes only content that the user intentionally provides, selects, imports, shares with the application or otherwise makes available to MioCC.
MioCC does not require general authority to browse, search or inspect unrelated files or folders on the user's device in order to perform its core encryption and decryption functions.
The user remains responsible for deciding which content is provided to MioCC and for ensuring that they have the lawful right to possess, process, protect and share that content.
4. Lawful use
MioCC is provided for lawful privacy, protection, storage and controlled sharing of legitimate information.
MioCC must not be used to facilitate criminal activity or other unlawful conduct, including fraud, threats, extortion, unauthorized system access, distribution of unlawful content, infringement of third-party rights or deliberate evasion of applicable legal obligations.
The availability of encryption or privacy functionality does not authorize conduct that would otherwise be unlawful.
5. User responsibilities
The user is responsible for:
• protecting passwords, PINs and other credentials under their control;
• choosing a suitable manually entered password or reviewing a locally generated password;
• securely saving the password before encryption begins;
• using COPY, PASTE and SHOW PASSWORD only in an appropriately private and trusted environment;
• clearing or replacing clipboard contents after use where appropriate and supported;
• transferring a password to another person or device through a separate trusted communication channel, preferably not the same channel used for the encrypted file;
• maintaining appropriate backups where necessary;
• maintaining reasonable security of their device;
• ensuring that content processed through MioCC is lawful;
• respecting the rights of other persons; and
• using MioCC in accordance with applicable law and these Terms.
The password-strength indicator is advisory and does not guarantee that a password is secure or suitable for every threat model.
MioCC does not provide automatic password transmission, a cloud password vault, cross-device password synchronization, password reset or developer-assisted password recovery.
MioCC cannot recover a password or other secret that the application is technically designed not to retain or have access to. Loss of information required to access protected content may therefore result in permanent loss of access to that content.
6. Prohibited use
The user must not:
• use MioCC for unlawful activity;
• distribute malware or knowingly malicious content through MioCC;
• process or distribute stolen or unlawfully obtained data;
• use MioCC to obtain unauthorized access to systems, accounts or data;
• infringe intellectual-property, privacy or other rights of third parties;
• circumvent or interfere with MioCC licensing, activation or security controls;
• unlawfully copy, redistribute, modify, reverse engineer or otherwise exploit MioCC, except where such restriction is prohibited by mandatory law; or
• use MioCC in violation of applicable sanctions or export-control laws.
7. Privacy, permissions and identifiers
MioCC uses device capabilities and system mechanisms only as necessary to provide functions initiated or selected by the user. Where the user selects or provides a file or other content to MioCC, the application may access that selected content for the requested operation.
Licensing records may include an internal record ID, license identifier or key, customer email, plan or MioCC edition, billing classification, license and activation status, permitted or registered device count, expiration or validity information and transaction identifier. Device activation records may include the associated license, Device ID, platform, device label, activation timestamp, last-seen timestamp, activation history and other limited technical metadata reasonably necessary to issue, administer, secure or verify a license.
Such licensing information is separate from the contents of files, messages, passwords, PINs and cryptographic secrets processed locally by MioCC. 8. Editions and licenses
MioCC may be offered in FREE, LIGHT, PRO or other editions with different functions, limits or licensing conditions.
A paid license provides a limited right to use the applicable MioCC edition according to the relevant license terms. It does not transfer ownership of MioCC or any rights in its source code, design, trademarks, documentation or other intellectual property.
The user must not bypass or manipulate licensing or activation controls. License availability or paid functionality may be affected where a license expires, is refunded, reversed, cancelled, determined to be invalid or is used contrary to the applicable license terms.
9. Purchases, payments and refunds
The Android application distributed through Google Play is currently offered as the FREE, consumption-only edition and does not sell licenses or paid functionality inside the app. LIGHT and PRO licenses are currently purchased separately through Paddle, which acts as an authorized reseller and Merchant of Record.
Where Paddle processes a purchase, the transaction is also subject to Paddle's applicable buyer, payment, cancellation, privacy and refund terms. Paddle is the seller and Merchant of Record for that transaction, while MioCC remains the licensor of the MioCC software and applicable functionality.
Nothing in these Terms limits any mandatory refund, withdrawal or consumer rights that apply to a particular transaction. Payment and refund information is available at https://ccyph.com/legal/refund.html.
10. Updates and changes
MioCC may receive security updates, bug fixes, compatibility updates, feature changes and new versions. Available functionality may differ between editions, platforms, operating-system versions and future versions of MioCC.
Material changes that affect users' legal rights will be handled in accordance with applicable law. Nothing in this section removes statutory rights that cannot legally be excluded.
11. Security limitations
MioCC is designed to improve the confidentiality and protection of user-selected content, but no software or security system can guarantee absolute security.
Security may be affected by circumstances outside MioCC's control, including compromised devices, malicious software, operating-system vulnerabilities, weak credentials, unauthorized physical access and user actions. The user should maintain appropriate device security and backups according to the importance of the information being protected.
12. Availability and recovery
MioCC does not guarantee uninterrupted or error-free operation. Temporary interruption may occur because of device conditions, operating-system changes, maintenance, technical failures, updates or circumstances outside reasonable control.
Where MioCC does not possess a user's password, PIN, private key or other secret necessary to access protected content, MioCC cannot reconstruct that secret or guarantee recovery of the protected content.
The local password generator, strength indicator, clipboard copy and paste, and password-visibility controls are convenience and security-support features. They do not create a backup, recovery service, password escrow or guarantee of password strength.
13. Intellectual property
MioCC, including its software, design, branding, documentation and related materials, is owned by or licensed to the MioCC owner and is protected by applicable intellectual-property laws.
Except for the limited right to use MioCC under the applicable license, no ownership rights are transferred to the user. Third-party and open-source components, where applicable, remain subject to their respective license terms.
14. Limitation of liability
To the maximum extent permitted by applicable law, MioCC and its owner will not be liable for indirect, incidental or consequential loss arising from misuse of MioCC, loss of credentials, failure to maintain appropriate backups, compromised devices, unlawful user conduct or circumstances outside reasonable control. MioCC does not assume responsibility for content created, stored, encrypted, decrypted or shared by users.
However, nothing in these Terms excludes or limits liability, warranties, remedies or consumer rights where such exclusion or limitation is prohibited by applicable law.
15. Suspension or termination of licensed functionality
Access to paid or licensed functionality may be suspended or terminated where reasonably necessary because of:
• material violation of these Terms or applicable license terms;
• fraudulent or unauthorized license use;
• license circumvention or manipulation;
• refund, payment reversal or cancellation affecting the applicable license;
• legal or regulatory requirements; or
• security measures reasonably necessary to protect MioCC or its licensing infrastructure.
Any such action remains subject to mandatory rights available to the user under applicable law.
16. Privacy and data deletion
Personal-data processing associated with MioCC is governed by the MioCC Privacy Policy available at https://ccyph.com/legal/privacy.html.
Requests concerning deletion of personal data are handled according to the MioCC Data Deletion Requests procedure available at https://ccyph.com/legal/data-deletion.html.
Deleting personal data associated with licensing may, where technically necessary, affect future activation, reactivation or verification of paid functionality. This does not affect rights that cannot lawfully be waived.
17. Adult users
MioCC is intended only for persons aged 18 years or older. MioCC is not directed to children and should not be used by persons below the applicable minimum age.
18. Governing law and mandatory rights
These Terms are governed by the laws of Montenegro.
This choice of law does not deprive a consumer of any mandatory protection that applies under the law and cannot legally be excluded by agreement. Nothing in these Terms limits rights available under mandatory consumer, privacy, data-protection or other applicable law.
